Q.  How do I find out if I need a building permit?

A.    106.1 Permits required.....except as specified in Section 106.2, no building or structure regulated by this code shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a separate permit for each building  or structure has been first obtained from the building official.

Q.  What about asbestos?

A.    Did you know that all commercial and public buildings must be inspected for asbestos before any renovation or demolition activity begins.  This is a requirement of the Montana Department of Environmental Quality.  It is not enough to have an EPA inspection, as they are only abating Libby Asbestos (zonolite).  The state program checks and tests for asbestos in building products such as fireproofing, ceiling tile, texture materials, floor tile and many other items that may contain asbestos.  For more information on this important building regulation, contact this office or Montana Asbestos Control Program at 1-406-444-5300.

Q.  What work is exempt from a building permit?

A.    A Building permit shall not be required for the following:

  1. One-story detached accessory buildings used as tool and storage sheds, playhouses, and similar uses, provided the floor area does not exceed 120 square feet (200 square feet for residential use)..

  2. Fences not over 6 feet high.

  3. Oil derricks.

  4. Movable cases, counters and partitions not over 5 feet 9 inches high.

  5. Retaining walls that are not over 4 feet in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding class I,II or III-A liquids.

  6. Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons and the ratio of height to diameter or width does not exceed 2:1.

  7. Platforms, walks and driveways not more than 30 inches above grade and not over any basement or story below.

  8. Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work.

  9. Temporary motion picture, television and theater stage sets and scenery.

  10. Window awnings supported by an exterior wall of Group R, Division 3, and Group U Occupancies when projecting not more than 54 inches.

  11. Prefabricated swimming pools accessory to a Group R, Division 3 Occupancy in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed 5,000 gallons.

Unless Otherwise exempted, separate plumbing, electrical and mechanical permits will be required for the above-exempted items.

Exemption from the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction.

Q.  How do I apply for a Permit?

A.  Application.  To obtain a permit, the applicant shall  file an application  in writing on a form furnished by the Libby Building Department. 
Every such application shall:

  1. Identify and describe the work to be covered by the permit for which application is made.

  2. Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify and definitely locate the proposed building or work.

  3. Indicate the use or occupancy for which the proposed work is intended.

  4. Be accompanied by plans, diagrams, computations and specifications and other data as required in Section 106.3.2.

  5. State the valuation of any new building or structure or any addition, remodeling or alteration to an existing building.

  6. Be signed by the applicant, or the applicant's authorized agent.

  7. Give such other data and information as may be required by the building official.

Q.  What are the Fees for a Building Permit?

* Or the total hourly cost of the jurisdiction, whichever is the greatest.  This cost shall include supervision,   overhead, equipment, hourly wages and fringe benefits of the employees involved.

Q.  What is required for inspections?

A.   As you complete a particular section of construction you must call the building official and request an inspection before proceeding to the next phase.  Building inspections follow a logical sequence and a typical on-site inspection order includes:

  1. Footing inspection after excavation and completion of forms and rebar is in place.

  2. Concrete slab inspection after all services and rebar is in place and compaction is done, but before the pour.

  3. Frame inspection after all framing, blocking and all utility work is completed and approved.

  4. Gypsum Board Inspection after all sheetrock is in place but before any joints are taped.

  5. Final inspection when building is ready for occupancy.
